Please note that these Terms of Service constitute a binding agreement between you and jobs.medicircle.in, and if You use this site, You agree to be bound by them. It is important that You read the following information carefully.
OVERVIEW
This webpage states the Terms under which You may use Medicareer.medicircle.in, an online service to search and post employment opportunities and User Profiles.
By accessing Medicareer.medicircle.in, together with all sites owned or operated by Medicircle Media Private Limited (“Medicircle.in”), collectively called the “Site,” You agree to be bound by these Terms of Service (“Terms”). If You do not agree with and/or comply with the conditions contained in the Terms, You may not use the Site or the Site’s services.
The words “You”, “User” or “Member” as used herein refer to all individuals and/or entities accessing or using the Site for any reason. The term “Your Content” or “User Content” as used herein shall mean information that You submit, publish or display on any Site provided by Medicircle. The term “post” as used herein shall mean information that You submit, publish, or display on Medicareer.medicircle.in.
These terms apply to Your use of the Site and all content both irrespective of the delivery platform You use (e.g. desktop PC, laptop, mobile device or otherwise), and irrespective of how the content is delivered to You (e.g. via web browser, Mobile Internet browser, email, SMS or otherwise).Your continued use of this Site and the Services following such modifications will be conclusively deemed acceptance of any changes to these Terms and Conditions.
On nonconformance by users of any of these terms, Medicareer may in its sole discretion, restrict or terminate the offending User’s ability to access the Medicareer site(s) and determine whether to take any other actions or to remove or request the removal of the User Content. Medicareer has no liability or responsibility to Users for performance or nonperformance of such activities. Additionally, Medicareer has the right to initiate appropriate proceedings against the offending user as per law.
- SHARING OF MEDICAREER.MEDICIRCLE.IN ACCOUNT ACCESS WITH DIFFERENT ENTITY/INDIVIDUALS/THIRD PARTIES NOT ALLOWEDYou are not authorized to share your password or other account access information with any other party, temporarily or permanently, and breach of this obligation may tantamount to disabling your Medicareer account and Medicareer Services.
- Medicareer site Terms of Use prohibits sharing of login /passwords with different entity/individual. In the event of any breach of security or unauthorized use of your login ID / Account you must notify Medicareer immediately. Medicareer will not be liable for any loss caused by any unauthorized use of your login ID / Account. You may be liable for the losses to Medicareer if any due to such unauthorized use.
Services
MediCareer controls and operates the Site from various locations and makes no representation that this website is appropriate or available for use in all locations. MediCareer services may not be available in Your location, and available services may vary among locations. Additionally, MediCareer will attempt to deliver all correspondence sent via the Site’s messaging system. However, the nature of this task is such that MediCareer cannot guarantee delivery of all messages.
Your Obligations and Conduct
In consideration of Your use of the Site, You agree to: (a) provide accurate, current, and complete information about You as may be prompted by a registration form on the website (“Registration Data”); (b) Your Postings shall be accompanied by your real name and shall not be posted anonymously; (c) Notwithstanding the previous sentence, if the applicable registration page for your participation in an Interactive Area allows you to create a screen name, you may select and use a screen name that is not your real name, provided that you use your real name when registering for participation in the Interactive Area; (d) Participants in Interactive Areas shall not misrepresent their identity or their affiliation with any person or entity; (e) maintain the security of your password and identification; (f) maintain and promptly update the Registration Data and any information You provide to MediCareer, to keep it accurate, current and complete; (g) accept all risks of unauthorized access to information and Registration Data; and (h) avoid using the Site if you are under the age of 13. If you are under the age of 18, you are not allowed to register on the Site and you must ask a parent or guardian to register on your behalf.
You are entirely responsible for all Content that You upload, post, or otherwise transmit through your use of the Site (“Content”). You agree not to upload, post or otherwise transmit Content that: (a) is inaccurate, harmful, obscene, pornographic, defamatory, racist, violent, offensive, harassing, or otherwise objectionable to MediCareer or other users of the website; (b) includes unauthorized disclosure of personal information; (c) violates or infringes anyone’s intellectual property rights; or (d) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. MediCareer reserves the right to edit or remove Content that violates these Terms or that contains third-party commercial advertisements.
The job posting, resume database (“Medicareer Resume Database”) and other features of the Medicareer Site may be used only by individuals seeking employment and/or career information and by employers seeking employees. In addition, the Medicareer Communities may be used by individuals for permitted professional and personal networking purposes. Your use of the Medicareer Services is also subject to any other contracts You may have with Medicareer. In the case of any conflict between these Terms and any contract you have with Medicareer, the terms of your contract will prevail. The term “post” as used herein shall mean information that You submit, publish or display on a Medicareer site.
Content Submitted to the Site
MediCareer does not claim ownership of the Content You place on the website and shall have no obligation of any kind with respect to such Content. Unless otherwise stated herein, any Content You provide in connection with this website shall be deemed to be provided on a non-confidential basis. MediCareer shall be free to use or disseminate such Content on an unrestricted basis for any purpose, and You grant to MediCareer an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, distribute, transmit, display, perform, adapt, resell and publish such Content (including in digital form) and authorize use of and have used on its behalf any ideas, expression of ideas, text, graphics, messages, links, data, information and other materials you submit (collectively, “Postings”) to this Web Site. Said license is without restrictions of any kind and without any payment due from MediCareer to you or permission or notification, to you or any third party. The license includes, the right to make, use, sell, reproduce, publish, modify, adapt, prepare derivative works from, combine with other works, translate, distribute -, display, perform and sublicense Postings- in any form, medium, or technology now known or hereafter developed. You represent and warrant that you have proper authorization for the worldwide transfer and processing among MediCareer, its affiliates, and third-party providers of any information that You may provide on the Website. You acknowledge and agree that your submitting Postings to this Web Site does not create any new or alter any existing relationship between you and MediCareer.
Advertisements and Promotions
Medicareer may run advertisements and promotions from third parties on the Website. Your correspondence or business dealings with, or participation in promotions of, advertisers other than Medicareer found on or through the Site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between You and such advertiser. Medicareer is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such non-Medicareer advertisers on the Site.
WAIVER OF CLAIMS & INDEMNITY PROVISION
You hereby waive all claims against Medicareer and indemnify its directors, employees, authorized representatives and agents from any and all liability for claims, damages (actual and/or consequential), costs and expenses including but not limited to litigation costs and attorneys’ fees of every kind and nature, arising out of or in any way whatsoever concerned with use of the medicareer Video Service and also arising out of your violation of any term of these Additional Terms of Use; your violation of any third party right, including without limitation any copyright, property, or privacy right; or any claim of video content submission causing damage to a third party. This defense and indemnification obligation will survive these Additional Terms of Use and your use of the medicareer Website.

You agree and acknowledge that your use and access of the medicareer service and medicareer website shall be at your sole risk, responsibility and consequences. LIMITATION OF LIABILITY
The concerned registered users, jobseekers and other contributor of content in medicareer website hereby agree and acknowledge that medicareer shall not be liable for their content submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with them.
In no event shall medicareer, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) Errors, mistakes, or inaccuracies of the content, (ii) Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website, (iii) Any unauthorized access to or use of medicareer secure servers and/or any and all video content and/or personal information and/or financial information stored therein, (iv) Any interruption or cessation of transmission to or from medicareer website, (iv) Any bugs, viruses, Trojan horses, or the like, which may be transmitted to or through our website by any third party, and/or (v) Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content submitted, posted, emailed, transmitted, or otherwise made available via the medicareer website, whether based on warranty, contract, tort, or any other legal arrangement, and whether or not the company is advised of the possibility of such damages. medicareer shall have the right to amend, vary or modify the Terms of Use, Privacy Commitment of medicareer Website and these Additional Terms of Use governing any medicareer Service at any time, without giving any prior notice to You and such amendment shall be effective immediately upon inclusion / posting of such amendment on medicareer
Use of the medicareer Resume Database by Employers
You shall use the medicareer Resume Database as provided in these Terms and in any contract You have with medicareer. You shall use the medicareer Resume Database in accordance with all applicable privacy and data protection laws, and You agree You shall not further disclose any of the data from medicareer Resume Database to any third party, unless You are an authorized recruitment agency, staffing agency, advertising or other agency or using the resume explicitly for employment purposes.
You shall take appropriate physical, technical, and administrative measures to protect the data You have obtained from medicareer Resume Database from loss, misuse, unauthorized access, disclosure, alteration or destruction. You shall not share Resume Database seat-based license login credentials with any other party, nor share Resume Database pay-per-view license login credentials with any party.
The medicareer Resume Database shall not be used:
for any purpose other than as an employer seeking employees, including but not limited to advertising promotions, products, or services to any resume holders;
to make unsolicited phone calls or faxes or send unsolicited mail, email, or newsletters to resume holders or to contact any individual unless they have agreed to be contacted (where consent is required or, if express consent is not required, who has not informed you that they do not want to be contacted); or
To source candidates or to contact job seekers or resume holders in regards to career fairs and business opportunities prohibited by these Terms of Use.
In order to ensure a safe and effective experience for all of our customers, medicareer reserves the right to limit the amount of data (including resume views) that may be accessed by You in any given time period. These limits may be amended in medicareer’s sole discretion from time to time.
10. Additional terms applicable to Job Seekers
When You register with any medicareer Site, You will be asked to create an account and provide medicareer with certain information including, without limitation, a valid email address (Your “Information”).
Any Profile You submit must be accurate and describe You, an individual person. The Profile requires standard fields to be completed and you may not include in these fields any telephone numbers, street addresses, email addresses or other means of contacting You, other than Your last name and URLs.
You acknowledge and agree that You are solely responsible for the form, content and accuracy of any resume or material contained therein placed by You on the medicareer Sites.
medicareer reserves the right to offer third party services and products to You based on the preferences that You identify in Your registration and at any time thereafter or you have agreed to receive, such offers may be made by medicareer or by third parties. Please see medicareer’s Privacy Policy (http://www.medicareerindia.com/privacy.html) , for further details regarding Your Information.
You understand and acknowledge that You have no ownership rights in Your account and that if You cancel Your medicareer account or Your medicareer account is terminated, all Your account information from medicareer, including resumes, Profiles, cover letters, saved jobs, questionnaires will be marked as deleted in and may be deleted from medicareer’s databases and will be removed from any public area of the medicareer Sites. Information may continue to be available for some period of time because of delays in propagating such deletion through medicareer’s web servers. In addition, third parties may retain saved copies of Your Information.
medicareer reserves the right to delete Your account and all of Your Information after a significant duration of inactivity.
11. Data Privacy and SMS Alerts
In the context of the ‘alerts’ service being introduced by medicareer; the candidate consents to the use of his personal data in the form of cellular phone number(s) being used by medicareer to forward relevant job alerts and other information as and when they become available.
